Abstract

This research aims at describing (1) the concept of law and politics in philosophical manner, and (2) the relationship of philosophy of law philosophy of politics. This library research philosophically analyzes the relationship of law and politics in Indonesia. In term of its making, law can be classified into two categories, responsive/populistic and conservative/orthodoxia/elite. Responsive law refers to law giving chance to individual and social group to participate in making it. The result is that the law will be responsive to the intentions of the group, elite law refers to a law containing vision of particular elite group, the government, that in turns functions as the means of the government's ideology. The result of the research shows that (1) law as constitutional rules is based on constriction that hierarchically issues many lower rule. Politics the is work of three democratic pillars political parties and representative institutions, free do of the press, and executive bodies. (2) There is interrelationship of politics and law. In most cases, law is much influenced by politics as political sub-system has greater power than the law has. Consequently, law is in a weaker position than politics.
